Is that a Dual SIM HTC a9 above or not? According to the technical details: No - but according to the pictures you can clearly see the two SIM slots on the side?

What colour do you see that for? And are you sure that this is not the microSD slot? If the specifications say "No Dual SIM", then this will very well be true. As far as I know, neither Digitec nor any other Swiss provider offers an HTC One A9 with Dual SIM.

NFC on this phone is reduced function which only works with payments. I bought it looking to use together with other NFC functions only to find that HTC wrote this detail in the manual. Its false adv

Being not specific about something is not false advertisement. Saying it could do other NFC functions apart for payment would be. If you don't research upfront about the features of a phone, it's your fault, not the manufacturers. Still, i'd like to know what other NFC functions you were expecting?
