Unfortunately, I can't say anything about the first point. At best, open a warranty case.
We also have this problem with hearing double in some cases. But not only with this headset, but also with the one that comes with it, which you connect to the controller. Switching the headset off and on or unplugging and plugging it in again always helps.
On the last point. Are you wearing the headset the right way round? It has happened to me several times that I had it on backwards. :) Then the mic is at the back and I can't be heard. The side with the buttons(switches) must be on the left.
