According to Wikipedia, the 3DS XL is sold in two display formats. One with IPS, the other with TN panel. You can only find out when you unpack the device and switch it on.
From the manufacturer's point of view, it is already a lottery whether you get an IPS panel or not.
It should also be noted here: No matter whether you get 1 IPS panel, it is not guaranteed that both have such a panel.
